General conditions of sale :

• Preamble

These conditions are concluded between, on the one hand, the company Planet Legendary owner of the site www.planetelegendaire.com registered in the Poitiers RCS under the number SIRET 514 548 486 00034, and on the other hand, people wishing to make a purchase via the Planete Legendaire website (www.planetelegendaire.com) below referred to as “the user”.

The parties agree that their relations are governed exclusively by this contract, with the exception of any conditions previously available on the site.

If a condition fails, it would be considered to be governed by the usages in force in the field of remote sale of which companies have their headquarters in France.
The sitewww.planetelegendaire.com is hosted by OVH (www.ovh.com).

• Acceptance

The only way to order goods on the sitewww.planetelegendaire.com results in the total and unreserved acceptance of our General Terms of Sale.
The user acknowledges that they have read and approved each of the terms constituting these General Terms and Conditions of Sale.
The acceptance of the "user" is materialized by the electronic signature made by 'validation and payment' by Paypal, or by sending a French bank cheque, transfer or mandate of the amount of the order.
"The user" further states that they have the capacity to conclude this contract.

• Subject
These conditions aim to define the terms and conditions of sale between Planete Legendaire and the user: from order to service, to payment and delivery. They regulate all the steps necessary to pass the order and follow up this order between the contracting parties.

1. The command

The user passes his order online from the site references. The order can only be registered on the site if the user has clearly identified himself by his email address and password after creating his customer account.
The acceptance of the order is materialized by an order number communicated with the detail by email to the customer.
Any order is to accept prices and descriptions of products available for sale.
Planete Legendaire is committed to honouring orders received on the website only within the available stocks of the products. If the product is not available, the legend planet is committed to informing the user as soon as possible and to refund by paypal or cheque the missing reference within 72 hours.
Planete Legendaire reserves the right to cancel the order of a customer with whom a dispute concerning the payment of a previous order exists.

2- Prices

The prices on the site are indicated in euros (tax excl. in accordance with Article 293b of the General Tax Code), excluding shipping costs. They are likely to vary, especially in the case of fluctuations in the currency price compared to the euro. However, the prices on your order after validation and registration are firm and final: if prices drop a few days after the order, we will not be able to compensate you for the difference; if prices increase, we have committed ourselves to delivering you at the price fixed on the day of the order. The delivery fee is calculated automatically according to each order; it appears on the summary of your order, before final registration. If you are a customer outside the European Union or in the TOM DOM, the invoice will also be made free of VAT. Any order delivered outside metropolitan France may be subject to any local taxes, customs duties, sea and customs clearance charges upon delivery. Their acquittal is your responsibility and is your responsibility. Contact the competent authorities of the country of delivery. However, the goods purchased by professionals are at the agreed price at the order within the limit of the option period and general economic conditions (taxes, exchange rates...), at the time of delivery.

3. Delivery

The user has the choice to be delivered:
- home
- to another address different from that of billing
Our deliveries are made by La Poste or by Mondial Relay (available only for France and Belgium)

Delivery with Post :

By means of Colissimo Follow-up, or in Colis Postal Priority for the International.
Planete Legendaire is committed to delivering the ordered items as soon as possible. The average deadlines are 3 to 4 working days for France, 4 to 7 days for Europe and on a case-by-case basis for the foreigner, upon receipt of the payment. Their overtaking cannot result in any cancellation of the order or compensation from the Customer.
Planete Legendaire cannot be held responsible for the consequences of a delay in delivery of its carrier.
In order to follow your delivery, we will contact you, on the day of departure of the parcel, a follow-up number to be entered from the next day on the carrier's site. This site will tell you in real time the position of your package in the circuit:

In case of delivery to a country other than Metropolitan France, you are importer of the ordered products. Customs taxes and formalities are at the sole responsibility of the Customer. The Customer is solely responsible for the verification of import opportunities for products ordered under the territory of the country of delivery.
For non-ECE and DOM TOM deliveries any taxes may be payable under customs and other import duties. These amounts will be entirely at your expense and responsibility for both declarations and payments to local authorities.

Delivery to the World Relay :

With the help of the Relay World Service, only available for France and Belgium, Planete Legendaire is committed to delivering the ordered items as soon as possible. The average deadlines are 4-5 working days for France and Belgium, upon receipt of the payment. Their overtaking cannot result in any cancellation of the order or compensation from the Customer.
Planete Legendaire cannot be held responsible for the consequences of a delay in delivery of its carrier.
In order to follow your delivery, we will contact you, on the day of departure of the parcel, a follow-up number to be entered from the next day on the carrier's site. This site will tell you in real time the position of your package in the circuit:

4. Returns

Planete Legendaire is committed to repaying or exchanging non-compliant products.
For this you have a 48-hour delay, upon receipt of the parcel, to send us an email stating in a very detailed way the problem (with a digital photo as far as possible).
At the time of receipt of the product, if you notice that the packaging is damaged, we urge you to immediately check the product. Notify in writing on the delivery voucher (La Poste) damage before receipt.
You can only return the goods to us after our written agreement. The return fee will be refunded to you at the invoiced shipping costs. This return must be made within 14 days of delivery of the order.
The refund will be made by paypal or bank cheque sent on behalf of the customer who has placed the order and the billing address.

5. Right of withdrawal

You have seven (7) working days to return, at your expense, products that do not suit you. This delay runs from the day you receive your parcel.
You will be reimbursed for the amounts paid, in return for the shipment of the goods at your expense within seven (7) days of receipt by Planete Legendaire, and provided that the product is in its original condition and packaging.

6. Payment methods

The user has the choice to pay his purchases:
- online secure with paypal order (Blue Card, Visa, Mastercard, Eurocard)
- by bank transfer, once your order is made, we will send you by mail our bank details so that you can make the transfer
- by bank cheque in euros and from a French bank, printing the order sheet and sending it all by mail. The check will be sent to Planete Legendaire – Résidence Morphée Appt 63, 2 avenue Clément Ader 86360 Chasseneuil du Poitou, et libellé à l'ordre de Planete Legendaire.
The Customer guarantees the Planete Legendaire company that it has the necessary authorizations to use the payment method by paypal or skrill, during the validation of the order form.
Online payment data are not held or retained by Planete Legendaire during payment and after payment.
All orders are payable in euros.
Any change in applicable rates may be impacted on product prices. After that date, they may be modified at any time.

7. Failure to pay

In the event of a total non-payment of the regulation, Planete Legendaire reserves the right to lodge or bring the client to justice and the procedural costs will be borne by the customer.
Planete Legendaire reserves the right to claim any work and article in case of default.
The customer undertakes to return any product not paid in full to Atelier de France, all costs to its charge, on first request from Planete Legendaire.

8. Signatures and evidence

Responsibilities

The figures on sale on Planete Legendaire's website are not suitable for children under the age of 14. Some models may contain dangerous corners or aspects (weight and other...)
Planete Legendaire has, for all stages of access to the site, the ordering process, delivery or subsequent services, only a medium obligation. Planete Legendaire’s liability cannot be incurred for any inconvenience or damage inherent in the use of the Internet network, including a breach of service, an external intrusion or the presence of computer viruses, or any fact qualified as force majeure, in accordance with the jurisprudence.

Nominating data

Planete Legendaire reserves the right to collect data on the user, including the use of cookies.

Intellectual property

All elements of the Planete Legendaire site, whether visual or sound, including technology and content are protected by copyright, trademarks or patents.
They are the exclusive property of Planete Legendaire. The user who has a personal website and who wishes to place, for personal use, a simple link directly to the planetelegendaire.com’s “home page” on their website must make the request to Planete Legendaire.

Integrity

In the case that any of the clauses of this contract would be null and void by a change in legislation, regulations or by a court decision, it would in no way affect the validity and respect of these general terms and conditions of sale.

Duration

These terms and conditions apply throughout the duration of the online service offered by the LEGENDAR PLANETE company.

The shipping costs are charged at the rate charged on the order form. They are calculated on the basis of the weight of each item, and correspond to the rates brackets shared by the post for the Colissimo Follow-up.

Under the law of 12 May 1980, Planete Legendaire retains the property of the product until the full payment of the price by the customer.

9. Payment

The price of the ordered items is payable in full to Planete Legendaire upon confirmation of the order on the site, according to one of the following rules:

- by paypal

- by cheque

- by bank transfer

10. Faculty of withdrawal

Under the conditions provided for in Article L121-16 of the Consumer Code and within the framework of the remote sale, the buyer has a 7-day withdrawal period from the delivery of his goods which will be refunded against the return of the goods delivered. The buyer must return the goods in their original condition and packaging. The return of the goods is at the buyer's expense, risk and risk.

11. Litigation

Claims or contestations will always be received with careful kindness, since good faith is always presumed among those who take the penalty to expose their situations.

12. Intellectual property
